Sewer Cleaning:

In cleaning or snaking sewers which are old, broken or separated, there is an increased risk that the cables from the sewer machine may become lodged in the sewer or pipes walls may fail and begin to leak. Should this occur, the property owner will incur any and all costs for removing the cables from the sewer and the repair of pipe(s). The cables will need to be removed promptly to avoid further damage to the sewer pipes located on the owner's property or those on the county side of the sewer line.  Additionally, the blades of the sewer machine(s) are sharp.  They are designed to cut through tree roots.  Old or degraded pipes could be damaged from the sharp blades.  The owner would be responsible for the cost of lost or damaged cables or broken/damaged pipe(s). 

Damages: 

We are not responsible for damage to personal property to include but not be limited to, attic insulation, ceilings, ceiling textures, walls, floor coverings, equipment, cabinets, counter tops, paint or stain, piping damage from sewer machines, nor for the repair of any cosmetic defects.  We do not repair or replace wallpaper, other wall coverings, or floor coverings.

Water Heater Disclaimer:

Customer has been advised that the water heater should remain set at 120 degrees as determined by the manufacturer and Gas Appliance Manufacturers Association (GAMA) standards.

Hazardous or Obsolete Materials:

We will not perform repairs involving hazardous or toxic materials.  We will not perform repairs on any equipment, systems, parts, etc. which we determine to be obsolete.

Mold Waiver and Release of Liability:

In consideration for the plumbing or heating services ("Services") to be performed by Covenant (the "Company"_, Customer acknowledges that the Services may have risk of mold and Customer expressly agrees to assume the risk of all damages and injury to property or persons, if any, resulting from any and mold related damages.  (Mold related damages shall include, but not be limited to, damages related to mold, fungus, rust, corrosion or other bacteria or organisms).  Customer hereby releases the Company and it's agents, owners, and employees from all claims, losses, damages, risks, or cause of action, whether now known or unknown, arising now or in the future and arising directly or indirectly, from the services which result in damages caused by mold or mold related issues.  This release includes claims related to property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, and adverse health effects, or any other effects.

The Company will not be responsible for the identification or notification of existing or future mold spores arising out of past, present, or future plumbing conditions.  Similarly, the Company will not be responsible for the cleaning, repair, removal, replacement, remediation, or abatement of affected structures or surfaces.  The Customer acknowledges that the Company has not made any representations regarding the extent or potential of mold which may or could result from the Services, nor the consequences of mold which may or could arise, and the conditions which may result in mold.  This Agreement is to assure the Company that it can undertake the Services without liability for any known or unknown condition which may result in mold.  Customer agrees not to bring any action, whether by litigation.  The Customer acknowledges that this Agreement includes work performed by the Company to complete the Services and results of the Services, both now and in the future.  The Customer acknowledges and represents that he/she is legally authorized to enter into this Agreement, that Customer has read this Agreement fully and understands the terms and conditions of it, that Customer is of legal age and legally competent to execute this Agreement and has done so of and has done so in consideration of the Services rendered by the Company.  This Agreement shall be binding upon and ensure to the benefit of the Company and the Customer and their respective heirs, executors, administrators, legal representatives and assigns.

Waiver:

In completing repairs, Customer recognizes that there is a risk of damage to persons or property. Customer recognizes that Covenant’s liability shall be limited to furnishing labor and parts necessary to remedy any defects in parts or workmanship which are covered by our Warranty. We are not responsible for personal injury or for any indirect, incidental or consequential damages to persons or property. In addition, we offer no warranty on plumbing connections to a Polybutylene system. All connections or repairs to this plumbing system are considered temporary until a full pipe replacement can be arranged. We will not be in any way responsible for damages which are the result of any leak from any part of the Polybutylene plumbing system, to this property or adjoining properties.
